Welcome to Climbing Gym Heaven. These Terms and Conditions (“Terms”) govern your access to and use of our website, located at www.climbinggymheaven.com (the “Site”), and the purchase of products and services offered by Climbing Gym Heaven. By accessing or using the Site, placing an order, requesting a quotation, or purchasing from us, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our Site, placing an order, requesting a quotation, or purchasing products or services from Climbing Gym Heaven, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use our Site or place an order.

2. Business-to-Business Sales

Unless expressly stated otherwise in writing, our products and services are intended primarily for business customers, including climbing gyms, route setters, distributors, resellers, companies, organizations, and professional users.

By placing an order, the customer confirms that they are acting in a professional or business capacity and that the products are purchased for commercial, professional, institutional, or organizational use.

3. Use of the Site

You agree to use the Site for lawful purposes only and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the Site by any third party.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

5. Quotations, Orders and Acceptance

Product information, price lists, catalogs, and other sales materials are provided for informational purposes and do not constitute a binding offer unless expressly confirmed in writing by Climbing Gym Heaven.

All orders are subject to acceptance by Climbing Gym Heaven. An order shall be considered accepted only when confirmed in writing by Climbing Gym Heaven, including by order confirmation, pro forma invoice, invoice, or written e-mail confirmation.

Climbing Gym Heaven reserves the right to refuse, cancel, or modify any order where product availability, pricing errors, technical errors, payment issues, shipping restrictions, or other reasonable business reasons apply.

6. Booking and Payments

All bookings, orders, and payments must be made through the Site or via e-mail with our Sales team. Payments are non-refundable unless otherwise stated in writing.

Unless otherwise agreed in writing, products remain the property of Climbing Gym Heaven until full payment has been received.

7. Prices, Taxes and Shipping

All prices displayed on the Site, in quotations, price lists, catalogs, order confirmations, invoices, and other sales materials are stated exclusive of VAT and shipping costs unless expressly stated otherwise.

Shipping and freight charges are calculated individually based on the destination, order size, weight, volume, packaging requirements, and selected delivery method, and will be quoted separately before order confirmation.

Any applicable taxes, duties, customs charges, import fees, bank fees, or other governmental charges are the responsibility of the customer and will be applied where required by applicable law.

8. Delivery, Risk and Customs

Delivery times are estimates only and are not guaranteed unless expressly agreed in writing. Climbing Gym Heaven shall not be liable for delays caused by carriers, customs authorities, force majeure events, supply chain disruptions, or circumstances beyond our reasonable control.

Unless otherwise agreed in writing, the customer is responsible for providing accurate delivery information and for all customs clearance, import documentation, duties, local taxes, and charges applicable in the destination country.

Risk of loss or damage to the products transfers to the customer in accordance with the agreed shipping terms or, where no specific shipping terms are agreed, upon handover of the products to the carrier.

9. Product Information and Availability

We make reasonable efforts to ensure that product descriptions, specifications, images, colors, dimensions, weights, and availability information are accurate. However, minor variations may occur due to manufacturing processes, material properties, screen settings, or product updates.

Climbing Gym Heaven reserves the right to modify, improve, discontinue, or replace products at any time without prior notice, provided that such changes do not materially reduce the functionality of confirmed orders.

10. Returns, Exchanges and Warranty

Returns or exchanges are accepted only with prior written approval from Climbing Gym Heaven. Custom-made, used, installed, damaged, discounted, or specially ordered products may not be returned unless defective or otherwise required by applicable law.

The customer must inspect all products upon delivery and notify Climbing Gym Heaven in writing of any visible damage, missing items, or defects within a reasonable period after receipt.

Warranty claims are limited to manufacturing defects and do not cover normal wear and tear, incorrect installation, misuse, improper maintenance, unauthorized modifications, unsuitable use, or damage caused by third parties, transport, or external factors.

11. Assumption of Risk

Climbing, route setting, training, and the use of climbing holds, volumes, walls, and related equipment involve inherent risks. The customer is responsible for ensuring that all products are installed, inspected, maintained, and used by competent persons and in accordance with applicable safety standards, instructions, and professional practices.

By purchasing or using our products, the customer acknowledges the risks involved and agrees to assume responsibility for proper installation, inspection, maintenance, supervision, and safe use.

12. Intellectual Property

All content on the Site, including text, graphics, logos, images, videos, product designs, names, catalogs, price lists, and software, is the property of Climbing Gym Heaven or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, sell, exploit, or use any content, product design, brand element, or other intellectual property without express written permission from Climbing Gym Heaven.

13. Prohibited Activities

You may not:

Use the Site for any fraudulent, unlawful, misleading, or unauthorized purpose.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions.

Unless otherwise required by applicable law, any dispute arising out of or in connection with these Terms, the Site, products, services, quotations, orders, or invoices shall be subject to the competent courts of the Republic of Slovenia.
